1. Acceptance of Terms

By creating an account, accessing the Service, or joining a challenge, you agree to these Terms and to any additional policies we post, including our Privacy Policy and payment-related disclosures. If you do not agree, do not use the Service.

2. Eligibility and Account Use

You must be legally able to enter into a binding agreement and comply with applicable law. You are responsible for maintaining accurate account information, safeguarding your login credentials, and all activity that occurs under your account.

You may not create accounts using false information, impersonate others, or use the Service on behalf of another person without proper authorization.

3. Description of the Service

Fitness Vow offers fitness challenges and accountability tools designed to encourage participation in personal fitness goals. The Service may include challenge enrollment, participation tracking, reminders, check-ins, performance review, payment collection, and outcome-based reward or return options.

Challenge outcomes are based on participation, completion status, and other criteria described in the app or challenge details. Fitness Vow is not a bank, escrow service, investment product, insurance product, or guaranteed savings vehicle.

4. Health and Fitness Disclaimer

Fitness Vow is a motivational and participation-based service, not medical advice. You are responsible for determining whether any challenge, activity, or workout is appropriate for you. Consult a qualified healthcare professional before starting or changing a fitness routine if needed.

You participate at your own risk. Fitness Vow does not guarantee any fitness result, health improvement, or physical outcome.

5. Payments and Participation Fees

Participation fees may be required to join a challenge or use certain paid features. By enrolling in a paid challenge, you authorize Fitness Vow and its payment processors, including Stripe, to charge the applicable amount and any authorized related charges.

Fees are charged for access to a participation-based service. Challenge outcomes may affect how much of a paid amount is retained, forfeited, credited, reused, or made eligible for a return, depending on the challenge rules and your participation record.

Payment processing is handled by third-party providers. We do not store full card details and are not responsible for downtime, processing errors, or card issuer decisions outside our control.

6. Performance-Based Outcomes

Some Fitness Vow challenges involve performance-based or participation-based outcomes. If you miss goals, milestones, or challenge requirements, part of your paid amount may be forfeited according to the applicable challenge terms shown in the app.

If you succeed or partially succeed, Fitness Vow may, in its discretion and subject to the applicable challenge rules, make some value available through one or more of the following:

• gift cards,
• in-app credits,
• application toward future challenges, or
• partial or full return of an eligible remaining balance.

7. Rewards, Credits, and Returns

Rewards, credits, reuse options, and returns are not guaranteed. Availability may depend on your participation, challenge status, account standing, fraud checks, geographic restrictions, technical limitations, or other eligibility requirements.

Fitness Vow may choose the method used to deliver available value, including gift cards, in-app credits, reuse toward a future challenge, or an approved refund or return. Promotional items, bonuses, and courtesy credits may have their own conditions and expiration rules.

8. Refund Policy

Refunds are limited to any remaining eligible balance, if any, under the applicable challenge rules and our review process. Refunds are not guaranteed in all cases.

Amounts already forfeited, consumed by challenge participation, applied under challenge rules, used toward fees, issued as credits, or otherwise made ineligible are generally not refundable.

We may deny or limit refund requests for misuse, abuse, policy violations, duplicate claims, disputed activity, incomplete verification, suspected fraud, or any circumstance where a balance is not eligible for return.

9. User Responsibilities

You agree to:

• provide accurate information, check-ins, and participation records;
• follow the challenge rules, app instructions, and community standards;
• use the Service only for legitimate personal participation;
• not abuse, manipulate, exploit, reverse engineer, or interfere with the Service;
• not submit fraudulent participation, chargebacks in bad faith, fake accounts, or misleading claims.

Fitness Vow may review participation data, account activity, and challenge history to enforce these Terms.

10. Digital Content, Promotions, and Expiration

Gift cards, credits, promotional offers, referral benefits, and similar items may be subject to restrictions, availability limits, redemption conditions, issuer terms, or expiration dates where allowed by law. Not all promotions are available to all users or in all locations.

11. Suspension and Termination

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe you violated these Terms, attempted fraud or abuse, created risk for other users or the platform, or if continued access is not operationally feasible.

Termination does not automatically entitle you to a refund. Any remaining eligibility for returns, credits, or other value will be determined under these Terms, the applicable challenge rules, and our reasonable review.

12. Limitation of Liability

To the maximum extent permitted by law, Fitness Vow and its affiliates, officers, employees, contractors, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, opportunity, or fitness results arising from or related to the Service.

To the maximum extent permitted by law, our total liability for claims relating to the Service will not exceed the amount you paid to Fitness Vow for the specific challenge or service giving rise to the claim during the six months before the event giving rise to that claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fitness Vow and its affiliates, officers, employees, contractors, and partners from claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your misuse of challenges, rewards, returns, or payment features.

14. Disputes and Chargebacks

If you have a billing, participation, or reward dispute, contact us first so we can review it. You agree to provide accurate supporting information and allow a reasonable time for investigation.

Initiating a chargeback or payment dispute does not automatically make you eligible for a refund or return. We may suspend your account while a chargeback, fraud review, or payment dispute is pending.

Unless prohibited by applicable law, disputes will be resolved individually and not as part of a class, collective, or representative action. Governing law and venue may be stated in a future service-specific agreement or challenge-specific terms if applicable.

15. Changes to the Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless another effective date is stated. Your continued use of the Service after changes are posted means you accept the revised Terms.
